Terms & Conditions
This Customer Agreement (“Agreement”) sets forth the terms and conditions governing your Account at TickTickTrader Ltd (“Company”, “us”, “we”, “Site” or “TickTickTrader” or other similar terms) and all Contracts and other transactions in this Account with TickTickTrader. In this Agreement, the undersigned customer is referred to as “Customer” or “You”.
Acceptance of Terms of Use
By using the Site and purchasing the services available to you through the Site (the “Services”), you agree to be bound by all terms and conditions contained in these Terms of Use (the “TOU”) concerning your use of the Site and the Services.
If you do not agree with the terms and conditions of the TOU at any time, please do not access the Site and discontinue your use of the Services.
We reserve the right to update or revise the TOU at our discretion and without notice. You are responsible for checking the TOU periodically for changes. If you continue to use the Site following the posting of any changes to the TOU, you agree to be bound by these changes.
The material that appears on the Site is for informational purposes only. Despite our efforts to provide valuable and accurate information, errors may occur from time to time. We are neither responsible nor make any warranty or endorsement regarding any third-party products or services listed on this website.
Access to the Services
We will make the Services available to you pursuant to this Agreement and the applicable Service Order(s) in accordance with your Subscription Term or Service Plan to which you subscribe until your subscription to the Services terminates.
All trading Evaluation accounts are paper Trading Accounts that operate in a Simulation Environment that clone/match the Live Market Environment.
At no additional charge, we will provide you standard customer support for the Services.
Billing and Payments
Unless otherwise expressly set forth in this Agreement or a Service Order, all Subscription Charges are due in full upon commencement of your Subscription Term. You are responsible for providing valid and current payment information, and you agree to update your Account information, including payment information promptly, with any changes that may occur (for example, a change in your billing address or credit card expiration date). If you fail to pay your Subscription Charges or any other charges indicated on any Service Order or if you do not update payment information upon renewal of your Subscription Term, in addition to our other remedies, we may suspend access to and use of the Services by you.
Unless otherwise stated, our charges do not include any Taxes. You are responsible for paying Taxes assessed in connection with your subscription to the Services, and we will invoice you for such Taxes if we believe we have a legal obligation to do so, and you agree to pay such Taxes if so invoiced.
Payment Agent
If you pay by credit card or other payment instruments, the Services provide an interface for you to change credit card information (e.g., upon card renewal). Payments made by credit card, debit card or other payment instruments for the Services are billed and processed by TickTickTrader’s Payment Agent. You hereby authorize the Payment Agent to bill your credit card or another payment instrument in advance periodically in accordance with the terms of the Subscription for the Services to which you subscribe until your subscription to the Services terminates, and you further agree to pay any Subscription Charges so incurred. If applicable, you hereby authorize TickTickTrader and the Payment Agent to charge your credit card or another payment instrument to establish prepaid credit. You will receive a receipt upon each payment acceptance by the Payment Agent, or you may obtain a receipt from within the Services to track subscription status. To the extent the Payment Agent is not TickTickTrader, the Payment Agent is acting solely as a billing and processing agent for and on behalf of TickTickTrader and shall not be construed to be providing the applicable Service. The Payment Agent uses a third-party intermediary to manage credit card processing, and this intermediary is not permitted to store, retain or use your billing information except to process your credit card information for the Payment Agent.
Refund Policy
All subscriptions made in Company are final.
Unless otherwise specified, each Subscription Term will automatically renew on every due date unless you have cancelled your subscription before the expiration of the then-current Subscription Term.
Your participation in, or failure to use, such purchased service does not entitle you to a refund.
No returns, refunds, or exchanges, partial or otherwise, for any reason. Once your order has been placed and your credit card billed or crypto payment processed, there are no returns or credits. You may not return the product and demand a refund, as you were also supplied intellectual property.
Your use of the Site and any publications, presentations, financial trading information, pricing data, trade data, performance information, blogs, postings or other information, content, services, and materials contained in, accessed via, or described on the Site is at your own risk. All such information, content, services, and materials are provided on an “as is” and “as available” basis. To the full extent permissible by applicable law, Company makes no and hereby disclaims all representations or warranties of any kind, expressed or implied, as to the availability, operations, and use of the Site or the information, content, materials, or services on or accessed via the Site.
Any purchases that result in a chargeback or payment dispute will result in TickTickTrader immediately deactivating your membership. Your username will be permanently banned from our database of authorized users.
Any chargeback initiated by you will be investigated to the fullest extent, and you will no longer be able to purchase any services from our company. Any additional purchases will be refunded immediately.
In no event shall Company be liable to you or any third party for damages arising from the use, access to, reliance on, inability to use, or improper use of the Site, any information, content, materials, or services available on the Site.
Data Disclaimer
TickTickTrader shall not be liable for any malfunctions, disruptions, or delays in service arising from causes beyond its reasonable control, including, but not limited to, failures of your computer, third-party platforms, internet connections or telecommunications or data feed providers. Additionally, TickTickTrader disclaims any responsibility for the speed, accuracy, or reliability of any third-party data or platforms utilized in connection with its services. By agreeing to these terms and conditions, you acknowledge and agree that you shall have no right to a refund or other remedy in the event of any issues or failures related to your computer, internet connection, or other factors beyond TickTickTrader's control.
Disclaimer of Warranties and Limitation of Liability
You expressly agree that your use of the Site and any publications, presentations, financial trading information, pricing data, trade data, performance information, blogs, postings or other information, content, services and materials contained in, accessed via, or described on the Site are at your own risk.
That all such information, content, services and materials are provided on an “As is” and “As available” basis. To the full extent permissible by applicable law, TickTickTrader makes no and hereby disclaims all representation or warranties of any kind, expressed or implied, as to the availability, operation and use of the Site or the information, content, materials or services on or accessed via the Site, including but not limited to warranties of merchantability, fitness for a particular purpose, title, noninfringement and implied warranties arising from a course of dealing or course of performance.
In addition, TickTickTrader does not represent or warrant that the information accessible via the Site is accurate, complete, reliable or current and is not responsible for any errors or omissions therein or any adverse consequences resulting from your reliance on any aspect of the Site. Further, TickTickTrader makes no representations and warranties that the Site will be uninterrupted, secure, or free of errors, viruses, or other harmful components. In no event shall TickTickTrader or its affiliates, or the directors, officers, employees, agents or representatives of TickTickTrader be liable to you or any third party for damages of any kind arising out of the use of, access to, reliance on, inability to use or improper use of the Site, any information posted on the Site by its users, or any other information, content, materials or services available on the Site (including, but not limited to, any direct, indirect, special, punitive, incidental or consequential damages or damages for loss of profits, goodwill or revenue, business interruption, or loss of data), even if advised of the possibility of such damages, and regardless of the form of action, whether in contract, tort, or otherwise. Specific state laws do not permit limitations on implied warranties or the exclusion or limitation of certain types of damages; thus, some or all of the disclaimers, exclusions, or limitations above may not apply to you.
Risk Disclosures
Futures and Forex trading contain substantial risk and are not for every investor. An investor could potentially lose all (or more) of their initial investment. Risk capital is money that can be lost without jeopardizing one’s financial security or lifestyle. Only risk capital should be used for trading, and only those with sufficient risk capital should consider trading. Past performance is not always indicative of future results. Hypothetical or simulated performance results have certain limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, since the trades have not been executed, the results may have under-or-over compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs, in general, are designed with the benefit of hindsight. No representation is being made that any account will, or is likely to, achieve profit or losses similar to those shown.
Privacy Policy
This privacy policy ("Policy" or "Privacy Policy") outlines, in general, the Personal Information (as defined herein) and other information that we collect from consumers and how we use and protect it. This Policy governs your use of our consumer-directed websites (the “sites” or “websites”) and collection of data through both online means and offline means.
Collection of Personal Information
As used in this Privacy Policy, "Personal Information" means personally identifiable information such as your name, street address, telephone number, credit card and other payment information, screen name, e-mail address, wireless e-mail address, short message service or text message address, demographic information and additional information that may identify you or allow online or offline contact with you. We may collect your Personal Information from you directly or from third parties in order to establish and maintain a service relationship with you that will be appropriate to the situation and your needs. We will only collect the information about you that will allow us to serve you efficiently.
Your authorisation will be obtained first if external resources are needed to verify or supplement information, such as a credit check for applicable products.
How we Use your Information
When you provide your Personal Information to us, we will use all or part of the Personal Information for the following purposes.
We are able to deliver our products or services to you by using your Personal Information and understanding how you use or interact with our products or services to help us evaluate and improve products or services, develop new products or services and conduct audits and troubleshooting activities related to the provision of products or services.
We use your information to send you information relating to your account and marketing communications, communicate with you about our products or services and let you know about our policies and terms. We also use your information to respond to you when you contact us.
How is Personal Information Shared?
The information we collect and use may be shared with third parties such as our affiliates, our suppliers or agents who assist in providing you with a service or as required or permitted by law.
We may disclose Personal Information as required by law, subpoena, or similar legal process. We may also disclose Personal Information when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud or respond to a government request or any other third party without your prior consent.
Indemnify
You agree to indemnify and hold us and our parent corporation, subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of the content you submit, your use of the Site, your violation of the TOU, or your violation of any rights of another.
Non-Personally-Identifiable Information we May Collect Online
We may use various technologies to collect non-personal information about your visits online so that we can tailor our sites and products to best suit your interests and needs. You may have heard of "cookies," which are small data files or pieces of information stored by your browser on your computer's hard drive. This information enables us to serve you and your interests better. TickTickTrader makes it a priority to protect your information with the appropriate safeguard and security measures.
Thorough security standards are applied to protect our systems and your information against unauthorized access and use.
As part of their contract with us, all of our service providers are bound to maintain your confidentiality and may not use the information for any unauthorized purpose. All employees of TickTickTrader are familiar with the procedures that must be taken to safeguard customer information. It is specified in our employment agreements and confirmed in writing annually.
Your Right to Consult or Correct your Personal Information
TickTickTrader will make every reasonable effort to keep your information accurate and up-to-date. You can help by keeping us informed of any changes, such as if you move or change your telephone number. If you find any errors in our information about you, let us know and we will make the corrections immediately. This will require you to provide proof of the information before we can make the change. We will also ensure that the correct information is conveyed to relevant third parties that hold this information about you. We will note your opinion in the file for information that remains in dispute.
Privacy of Children Online
We are committed to protecting children's online privacy and making the Internet safe for our users. We do not offer products or services to children under 18 years old and will never knowingly collect information from minors. Minors should not place orders or provide personal information through this website.
Security of Information
Your account is protected by a password for your privacy and security. If you access your account via a third-party site or service, you may have additional or different sign-on protections via that third-party Site or service. You are responsible for maintaining the strict confidentiality of your account password.
